Technically while there may have been an intent to race, the vehicle was not actively participating in a contest of speed or racing event at the moment of the incident, the failure was mechanical in nature (within the designed parameters of the vehicle, any modifications notwithstanding (notwithstanding disclosure of those modifications to the insurance company)), not the result of driver error/circumstance during participation in a race.
It would be an interesting debate with the insurance company and the guy's lawyer if they challenged it. Additionally, track day insurance is commercially available.
