Unfortunately "the dealership cannot be sued because of a legal standard preventing an employee from suing their boss for negligence, which, in this case, would be the hiring of someone who should not have been driving."

So the deceased's family sued the 19 year old w/ no license who didn't know how to drive a stick directly (no money there) and the insurance of the owner of the Jeep (plenty of money). The owner's insurance will eventually pay and the insurance company in turn will sue the dealership to recover their costs. The dead guy's family should definitely be compensated, but it sucks they are forced to go this route to do it. The Jeep owner will probably also lawyer up and sue the dealer for having to endure all this shit.

Simple fix😁. Every customer has to be given FULL Disclosure Document to sign alerting them the Dealer has no responsibility or Liability coverage while working on your vehicle. Damn the Porter could be parking your car and run over a customer and now you have a lawsuit. Uh huh what dumb ass is gonna sign this….yeh a few but this would change things.

This is total BS and a money grab. The owner of the vehicle had nothing to do with the death. The kid shouldn’t have been moving the car if he didn’t know how to drive a stick. By the way, our AG us a dumb b!tch so this is par for the course.

Live in Fl on a golf course. Truex Jr winds tonight. The kid should and is covered by the companies liability insurance policy. If you have been a contractor of sorts. The minimum coverage is 1 million $$ with riders on top.

As an RV dealer I never imagined if a customer dropped off a motorhome for service and one of my employees accidentally killed someone with it at our facility,
the customer was responsible. I can guarantee you no customer is aware of this risk.

Liability laws vary from state to state...with some bizarre ramifications....for instance ...in NY...we are a vicarious liability state..say you hire a contractor to put a roof on your house..they break for lunch and one of the workers has one too many beers @ lunch...they come back and the impaired worker falls off your roof and breaks his back...guess where the liability is....YOU the home owner...welcome to NY state..
